Self-Defense
Question of the week?
Is it legally justifiable (by our courts interpretation)to actually cut vital templets (ie 3 of 9) into a would be victim.

I THINK YOU WOULD WIND UP IN FRONT OF THE JUDGE FOR THAT. AFTER THE FIRST COUPLE OF STRIKES IT WOULD BE CONSIDERED AN EXTREME USE OF FORCE. IN A LIFE OR DEATH SITUATION YOU HAVE TO DO WHATEVER NEEDS TO BE DONE TO STAY ALIVE. BUT THE COURTS WOULD THINK DIFERENTLY.

The use of force must be commensurate with the danger. A person may not use deadly physical force in self-defense if he knows there's another way out of danger, according to Arkansas law. A person should retreat, except a person is not required to retreat if he is in his home and isn't the initial aggressor.
Arkansas doesn't allow deadly force to be used as a first option.
I would think that you would be justifiable cutting vital areas.

WOW!!!!Good question. I dont really care what the answer is though, if they are in my house they a threat to my babies and its till the end, no running. I been in a bad mood lately.

I just printed it out...I will take it to class next week and let one of my students decipher all the Mumbo Jumbo....He is our City Attorney.
