I Hate our Land lord...now.
Okay this is my rant...but so that you'll understand let me go back to the beginning so you'll have an idea of what's going on...
Last year in January (2007) we saw the house and loved it...it had two driveways the first was for us and the second belonged to Apt. A as it had the carport...also with the understanding that we'd could use part of the basement......Excellent...
After we moved in, hubby cleaned up the corner of the basement and made me a nice little office....He was in the process of straightening up the rest of the basement when a leak occured under apartment A..when Leon (the landlord) came over to fix the leak he said he didn't want us using the basement. Immediately hubby removed my office and we closed the door and never went back down stairs (by this time, hubby had begun stacking the wood etc.. into catagory/size and once that was done he was going to build shelves to place the lumber and all on and get it off the floor the basement was 3/4 of the way to being neat and tidy)
Okay that was around March of last year. Then in April the storage place where we had our old trailer stored told us they needed us to remove the trailer because they were going to be building more storage units..I called the land lord and spoke to Francis (the land lord's wife). I told her what the Storage place told us and then I elaborated and told her that hubby wanted to tear the old trailer down to the frame and re-build it. I also told her that it may take a while to do the re-build (mainly because of the fact that we're on a fixed income)...I even stated that I couldn't give her an exact date of completion and she told me told problem. She did ask me where we were going to park it and I told her partially under the second Magnolia Tree but in the driveway not on the grass (Lease states specifically that no vehicle was to be parked on the grass)...and again she said that would be fine.
In May (07) when we went over to pay the rent..I again brought up moving the Trailer to the property..but this time to both Leon and Francis...and they both (once I again said where it would be parked) agreed. So in the middle of May (the exact date I don't remember) we had the Trailer brought over and parked it exactly where we told the Landlord we would. (Footnote: Francis knew exactly where I was talking about...because she frequently voiced that she loved the two maganolia trees and wishes she could have one in her yard)
We complained about the refrigerator continuously because it would defrost and our meat would thaw out to where we couldn't trust the meat...after 7 months of this complaining we finally went to Aaron's and did the rent-to-own on a brand new refrigerator.
We complained about the floor in the bathroom and kitchen since April (2007) and never had them come over to fix the sagging floors (when we were still able to go into the basement we could look up and actually see the carpet backing through rotting floor boards).
We complained about the commode not working correctly (not flushing properly) and finally in the end hubby went and got a new Ball and **** for the tank and fixed it himself--this was after 5 months of no -one coming to fix it..
The same with the door locks (sticking, the key not working half the time)...hubby went and brought both door knobs (with key locks) and dead bolts (both were twin sets so one key would unlock both regular door locks and one would unlock the dead bolts)
FAST FORWARD... (keep in mind that every month both Leon and Francis had seen this trailer in various stages of being stripped and the slow process of re-building -- it is currently about half finished)
The first drive-way has always been ours. the second driveway has been Apt. A's as it has the attached Carport. I know the other apartment has the front porch that faces our driveway..but every tenant has always made the front room (at the front porch) into a bedroom and used the middle room as the living room. They've always used the back door (off the Carport) as their main entrance...and very rarely would they park in the front (usually the previous tenants would ask first if they could park a friend's car in ours as the other driveway was full at the time) and we've never had a problem with that...
Finally after over a year of complaining about the floors..the land lord comes over (March of 2008) and begins the process of re-placing the bathroom floor..But first they stripe the basement (clean it completely out) and piles everything on the side of the house the MOLD and MILDEW smell was horrible..to the point that I'm almost trapped completely in the house because I can't breathe (starts an Asthma attack when I go outside). They remove the fixtures (breaking/cracking the commode in the process) then begin removing the floor..
The contractor accidently drops his hammer (once the linoleum was removed) and it goes through the existing flooring like it was water. They pointed out that the Tub wasn't even being supported (the joists and floor beams had decayed/rotted so much that it could have fallen through at any time). While they worked , Apt A was empty at the time and we had to go next door to use the bathroom (the Tuesday after I had the spinal block done the first time..I took a misstep, off Apt A's porch, and threw my back out again--destroying the effects of the block). We lived with no bathroom for a little over two weeks...the contractor did re-inforced the flooring under the tub so when it was finished we had a workable and a safe bathroom. The Landlord also had the contractor seal up the basement door (no access from our apartment--like we would go there after he told us no).
In the mean time the pile of debri they pulled out of the basement in March is still piled up on the side of the house. We can't mow the lawn around the garbage because if we ran over anything from the pile (its not a neat pile) the mower would/could be damaged....
3 months ago..Frances began complaining about the trailer and our van that is parked in the front (on the driveway and as close to our porch as possible without being on the grass). The Transmission is blown in the van so we've been setting money aside to get it fixed and in the process of saving to fix the van we have not been able to work on the trailer...Which I explained to her each time...We need a vehicle because we live to far out to use the city bus system. ...
She wanted us to move the trailer down the hill beside the house..which I pointed out to her that the Lease Contract states plaining NO VEHICLES ARE ALLOWED TO BE PARKED ON THE GRASS...and to make another point that it was impossible to move the trailer to the new designated spot was the PILE OF DEBRI they had removed from the basement was still there.
Okay now I'm almost to the current time frame....at about the same time that she started complaining about the trailer and van....She came over (more or less crying on our shoulders) crying that Leon had been diagnosed with Alshiemer (sp?) that she didn' t know what she was going to do etc...(she's Leon's second wife) because she feared that his children would get Power of Attorney and more or less push her right out of the picture...
All during this time..Leon has not once complained about the trailer..in fact he has even offered a couple of suggestions and sympathy about the stumbling block we've found ourselves in with the van busted etc...
Oh Apt. A has been empty for nearly 3 months..(last week they finally brought a person over to clean it up)...they showed the apartment to someone on Thursday...Friday when Leon came to pick up the rent...he for the first time mentioned the trailer...that people would see the trailer then walk away...(rejecting the Apt.)...He wanted to know what we planned to do..and for the umpteenth time I explained..I even went as far as telling him that Francis wanted us to move the trailer down the hill and why we couldn't (the debri still there as well as the Stipulation in the Lease contract).
About an hour later, Francis calls and the very first thing she wanted to know was when we were going to move the trailer. Then she begins ranting and raving about the potential tenant for Apt. A wants the trailer out of in front of their porch...as well as our van...When I asked her why she was allowing the potential tenant dictate to them, she didn't answer but re-itterated that she wanted the trailer and van moved..When I asked her where we were supposed to park our vehicle she said infront of our steps/porch WHICH WOULD BE ON THE GRASS. I told her flat out no...the first driveway is our entrance and the second driveway has always belong to Apt A. She then suggested we put the trailer and van at the back of the house...and I asked her HOW? There's a carport the trailer would not go through the carport and the neighbor's Moble home is too close to allow us to pull between their home and the carport.
She again suggested down the hill and again I told her...How? Until you get that garbage from the basement removed the trailer can not be put down there...and again the stipulation about the NO GRASS Parking...I told her If she got that debri removed and gave us a WRITTEN AUTHORIZATION to park it there then we would...but OUR VAN was STAYING PUT IN THE DRIVEWAY
I want OUT of this mad house...I think both Leon and Francis have Alshiemer as they never remember what we tell them from one month to the next (I've had this same conversation with Francis --not this heated-- two or three days apart and its like I'm a broken record). But what really set me off...Francis has been over here a dozen times since the bathroom was worked on...she has seen the pile of garbage on the side of the house and Friday she claimed she didn' t know that it was still there. ARGH!!!!
There's more but this is ICING on the Cake that at the moment is the foremost cause of my frustration.

First, I am sorry, Granny, not respond before ,.... the translation, has taken me more time to be a message so long.
I think, dear, you've already had too much patience, and they've given time, more than reasonable to solve your problems.
He endured a similar situation, in the last house I rented, (before the death of my husband ),.... but the owner, lived in another city, and, practically, there was no way to locate him.
Perhaps, Moonie, is right ,.... if there are any office or organization to defend to tenants, may be the time when they are used ....

I'm really a bit afraid to lodge a legal complaint...If they evict us (which they can not do because of a complaint) Allen and I have discussed this and we will fight them if they try to because of the trailer....It will be basically their word against ours...but I had hubby take pictures of the side yard Friday evening (before it got to dark) and he got some good shots of how the Weeds (and grass) has grown up through the pile of debri and in some areas (close to the pile) where the grass is almost hip high.
And I'm trying to locate on one of the boards where I've mentioned the smell of the pile.
I think we've got a good case, but if we loose we have no place to go. I know the church would help us...but....(pride is getting in the way in that one respect)....we've got so much stuff....and Yoda....

Here are some pics of the pile of debri on the side of the house (where the Landlady wants us to put the trailer)....
In the above pic the mattress you see buried in the pile is a Queen size mattress that they removed from the basement covered mold and mildew
(Okay I'll have to come back later to finish downloading these pics--ImageShack is acting up on me)

Okay, finally got ImageShack working again...
This last pic may give you a bit of a perspective as to how big the pile is...the porch where I'm standing at that end is 8 feet from the ground...and that door you see on the other side of the chimney is a standard 6' 6" and 36" wide.....

I understand your point, dear, not to file a legal complaint ,.... but, my friend, you can not continue living, so ,..... with all that junk ... these photos speak for itself.
You have no possibility of finding another home, and then make a complaint?
Actually, I much angry, everything you already happening, and it is not fair that you have to endure this situation ....

I'm still hoping that we can get the house across the street....hubby's Italian temper can be so frustrating at times.
I hate moving...mainly because Allen drags tail and keeps putting off packing to the last minute which makes for one hell of a hectic moving day--I'll have everything pretty much packed with the exception of the kitchen and most of my room but he would not have even touched his work shop by the time moving day arrives. (when the church comes over they'll move everything out in less than 3 hours but then we end up taking junk/trash with us)

The idea of Aims, Granny is very good,
In terms, to get another house, and the "problems" of Allen, to packing, if members of the Church help you, perhaps, might be the solution.
As I do not know how they work, or, what are the laws there, perhaps, I am not the most appropriate person to give advice .... quote: hubby's Italian temper can be so frustrating at times.

Both hubby and I have thought of having the health department come take a look at the pile...but to be honest...we're a bit afraid that if we do they may take one look at the house and condemn it then again we'd be out in the cold....
Technically if the HD condemned the house...the Landlord would have to pay to have us moved....but there is a little glich to that plan...all they'd really have to do is pay for our stuff to be moved into a storage unit and put us in a hotel/motel for a week and that would fulfill their obligation....(at least according to Tennessee Laws)
The only way for us to win in this situation is to let them take us to court (try to force us to move the trailer or evict us)...and then its 50:50 odds on the Judge ruling in our favor....It would be up to the Judge to ORDER the landlord to pay for the complete move into another place (other than a hotel/motel). And if we loose we would only have thirty days to move the trailer (or if its an actual Eviction proceedure--to find a place and make the move)...
I did mention to hubby that we might have a solution....K and O are buying their home...if push comes to shove we might be able to move the trailer behind their garage/shed and it would not be visible from the road at all....
Its a thought..but I agree with hubby that 'WHY SHOULD WE BE INCONVIENENCED and made to move the trailer when we had the Landlord's permission in the first place.' this option I'm going to bring up to K when he takes us around on Allen's payday...assuring him that it would only be used as a last resort.

If I lived anywhere near you I'd let you come stay with us (am sure mum wouldn't mind) until you got sorted. But there's a bloody big pond in the way, so that option is out.....unless ya wanna come to the UK and visit. :bigsmile:
I wish I could think up a solution for you.....ooh how about I send you one of my rats (probably Sam as he's currently trying to eat my bed), then you could show pics of the junk with a rat....surely that would go in your favour!
Seriously though hon, I hope it gets sorted out soon.

Oh I plan to have the church help with the move...they help move us the last time...but the problem wasn't getting the help...it was that Allen only packed one box in his work shop and then when we finally got moved he complained that he couldn't find anything because they just threw things in boxes willy-nilly instead of packing according to what it pertained to...(he had a whole month to pack up his room and he kept procrastinating)
Its just how do we ask for help financially because that's what it would take....I know the church would help all it can but it's an awful lot.
The rent, the deposit, the pet deposit the transfer fees for most of the utilities and a hefty Deposit for the electricity (the Electric won't carry the deposit over to a new address--you have to make a new $250-300 deposit every time you move)...we'd be looking at roughly 11 to 1200 dollars...and we just don't have it...Plus it would have to be to a place that we could afford the monthly payments...
There are areas of town that does have very low rent but those areas are filled with drug pushers, users, prostitutes and gangs...I'm always reading in the paper about shootings etc...so I don't want to move any where near that area of town--my nerves couldn't handle it and the fact that I'm alergic to the Wacky-Weed...I'd never be able to go outside.
I'm just so frustrated at the moment as to what to do...

Queeny, that is an excellent suggestion...but as far as the Church goes we're already doing the Barter system with the church for our Titheing...
There is a Trailer park (that is really nice in appearance and all) over near my Main Doctor's office...I think I'm going to give them a call on Monday...find out how much they are per month...a friend once told me the Trailers are all furnished...and that will be a problem...with all our stuff ...but maybe we can talk them into moving their stuff out....I'll find out Monday.

I Kind of like where those trailers are located....but I doubt if we can move our partially finished camping trailer there...so If we do move there we may have to rely on our friends to store the trailer for us...I'll find out Monday...but in the mean time I will be talking to our Bishop in the morning...so we'll see what happens...
But again I'm feeling very angry...why should we move just to please them...I wish they would take us to court (try to evict) because I would so like to see what a Judge would say to all the B...S...-- hubby feels that if we went to court there's two things that could happen...
1: The Judge will rule in our favor and make the Landlord PAY IN FULL for our moving
2: because of the harrassment and inconvienence etc...we end up owning this house lock stock and barrel...(this second one I doubt but hubby feels strongly that its possible).
We have decided that we are not moving the trailer or the van unless we have a COURT ORDER to do so...we are not going to be bullied....
(as a precaution I am going to start bringing home boxes and start packing the stuff we don't need immediately)

I didn't go to church today...so I'm hoping Allen remembers to talk to the Bishop...I won't know if he did or not for at least another hour. (Church lets out at noon but if he's talking to the Bishop it could take some extra time)

Unfortunately, Allen didn't talk to the Bishop...we did talk to T (the Elder's Quorom President) and explained everything...he may talk to the Bishop in our place...he did advise us to keep him informed if anything changes/happens..he's also going to look and see if he can find a house we can afford to rent via the church.

Ouch! Sounds like you have had a really bad time with the landlord. That is the real issue with renting. *hugs*
Like Aims - I would offer that you could come and stay with us but the ocean makes it difficult and we don't have a huge amount of room either! LOL!
