Here’s another, albeit brief article, that stops just short of naming GWB as the “ultimate culprit” in this scenario, but the reference to the Nuremberg Tribunal strongly hints at it.

Haditha Charges Raise Liability Questions
Experts have said criminal charges filed against eight U.S. Marines in connection with the deaths of civilians in Iraq could lead to questions about liability.
Four Marines were charged with the killings of 24 civilians in Haditha, Iraq, and four officers, who were not present during the incident, were charged with failing to investigate and report the killings, the Christian Science Monitor reported Friday.
Military experts have said the charging of the four officers could raise new questions about the liability of superiors when soldiers are charged with abuse and killing of prisoners and civilians.
"Under the law of armed conflict, if a superior knew, or should have known, of a subordinate's misconduct, and he took no action to stop it or to punish it, then he is himself personally criminally liable for the crime committed," said Gary Solis, a 26-year Marine Corps veteran who served as a courts-martial prosecutor and judge.
"That's basic World War II Nuremberg Tribunal stuff," he said. "But how often have we seen the principle honored? Not often."

Maybe Bush, Perle, Wolfie, Cheney et al should be the last ones left in the Green Zone with all the new Iraqi security forces they can feed, a clear pass for the marines to clear out; and just let the Iraqis figure out the rest from there.
Evacuation can be a bargaining chip, a good incentive for real majorly subdued conflict, not just the 'Hollywood does el-Boulevardai' gunner teams looking for trouble kind which are making US Marines the subject of severe hatred - not good for them or the future of the corps at all.
