San Onofre Beach updates
Now that we're headed for court again, this is the correct place for all future updates.
I was at San Onofre beach today (sunny, crowded, gorgeous, perfect water!) and was able to talk with Allen Baylis to separate fact from rumor. Here's a quick summary:
1. We have the beach through Labor Day.
2. NAC will file a final appeal to the Calif. State Supreme Court by the filing deadline of Aug 3rd.
3. During the time between the filing of the appeal and the decision of the Supreme Court to either reject the case or hear it, the case is still considered "under appeal" and the first ruling by the lower court stands (ordering status quo of the Cahill Policy to permit nudity in the absence of a filed complaint by a citizen).
4. The Supreme Court hears only about 10% of the cases brought to it. Bummer.
5. If the appeal process goes past Labor Day, we are legally entitled use the beach. Allen said that the attorneys/rangers of the local office might not be fully aware of this and there could be on-beach orders to dress as there were recently. But that's down the road.
I discovered that I'm rusty as an old nail on the board after months of not surfing. And so....I'll be out there just about every weekend from now until Labor Day, nude surfing on "Baby Blue" as I was today.
(Lordy, lordy...there was the most beautiful blonde, nude surfer girl out there today with her fiance, on a pink board with white stars!! Being behind her in the water as she took off, stood up and shot across the wave all wet in the late afternoon sunshine would make the Pope kick a hole in a stained-glass window!!!)

i can't beleive a case like this would go to the supreme court...i think the supreme court has more pressing matters than this...this is a huge waste of time and money..especially the way the economy is..

Liz,
I Pray the State Supreme Court does decide to hear this case. If they don't I believe we will lose San Onofre as a Clothing Optional Beach. Also, the 30+ years of nude use becomes a thing of the Past.
With this ruling ALL Clothing Optional use in ALL of the State Parks System is in jeopardy. This ruling by the current Appeals Court does away with the status quo that has been in place for over 30years.
Let's hope this will cause the State Parks to acctually Designate Nude Use by the action of the Higher Court.

Update 7-23-09
Reports of the demise of clothing optional use of state parks are premature!
The Naturist Action Committee and Friends of San Onofre Beach have filed their Petition for Review in the California Supreme Court. This action along with others being taken by us effectively puts the Fourth District Court of Appeal’s order on hold. Therefore, the Cahill/Harrison Regulation is at this time valid and enforceable throughout California.

Please be assured that the Naturist Action Committee, Friends of San Onofre Beach, and our attorney, Elva Kopacz, are working hard to continue the fight to save the traditional clothing optional beaches in the California state parks. The Naturist Action Committee continues to represent the interests of Naturist Society affiliated public lands naturist groups throughout California.
Additionally, the Parks Department has now stated publicly on several occasions that they will not issue citations until after Labor Day. Based on our legal actions, however, it will likely be much longer that that… if ever.

No citations were issued to nude sunbathers on Tuesday, although the DPR says the rangers may if they want. A rally is planned for next Sunday, Sept 13th. More info is in an article here: http://www.ocregister.com/articles/state-beach-stearns-2557207-court-nudity
Five minutes ago I emailed Allen Baylis and asked what the nature of the Attorney General's statement was to the rangers that supposedly allows them to do this. His reply is that they responded to his letter a while back, citing law that "simply doesn't apply."

Since the State of California is so broke they plan to close/sell State Parks, it might be the time to ask the State to designate one of these parks or beaches as clothing optional, and just leave the gate open.
No administrative costs, no maintenance cost. Have the local cops drop by once in a while to make sure cars aren't being stolen.
And folks going there will be spending money on gas, food, lodging in the area. The locals benefit, the State doesn't spend money on the Park. And I'm sure some clothing optional types will be keeping the place clean just so they can use it.
Isn't that how Haulover went CO?

Trainguy's proposal sounds good to me, but a direct designation I am sure would be politically impossible. If there could be some wigwagging between the parks administration and naturists that created a de-facto situation on the ground, as happened with Haulover, then the benefits trainguy mentions would happen and there would be a constituency to keep it clothing optional.

I wish my livelihood,my family and my MIL did not depend on me as much as they do or I would be joining you in the heat of the battle.
