Thanks Photo Tane. Donations are the best thing anyone can do right now. No matter how small. The NAC attorney is hired and not part of the organization, so this is now where the support is most needed.

We had our rally today! A beautiful, sunny beach day in Southern California with 72 degree water. Over 100 people on the beach...all nude. Three news crews came to interview all willing people. The rangers never showed their faces all day, as we pretty much thought. An excellent rally and an excellent day in the sun for a bunch of rebels! LOL!

Here's another well-balanced story and photos from the Orange County Register. Cindy, the reporter, and her photographer just yakkety-yakked and laughed with us for the longest time. The photo of the sign at Lighthouse Beach is mine, and I'm the one holding it.

Chuck perhaps you can confirm what I just learned today. The officer who has been causing the enforcement issues, plus he got the new commissioner to take legal action, he no longer works for the State - at least not at SO. I hear he was forced to resign.

What I understand from Allen is that this ranger has retired. Whether by choice or instruction, he has retired. Unfortunately, what he and the district superintendent began is in full force. The entire future of San Onofre Beach is now in the hands of the Calif Supreme Court. If they decide not to hear the case, we're done; the rangers can legally issue citations at will.

As of right now, NO citations have been issued. Our protest rally was quite an event. We believe as we always have, that the rangers have been bluffing. The law is on our side about the appeal status of the beach. We have called their bluff and they've blinked and backed down. I will BE THERE this weekend with my 9'6" board!!!!

If you're there I'd love to shake your hand! I'm between the wash and the volleyball net with my grey cart with the big, dune-buggy-style tires and the big blue board.

I really hope the Court hears the case and rules in a fair and just way! I always worry about the slant of a particulary judge. They can either be for you or against you. And interpret the same law according to their particular prejudices.

We just lost San Onofre Beach. The Calif Supreme Court today declined to hear the case. The rangers can issue citations immediately. 30 years of peaceful CO use of the beach ended by three recently-hired employees who personally didn't like it. We're done...I can't tell you what this feels like.

Dear Naturist,

This is an update from the Naturist Action Committee (NAC) on the status of San Onofre State Beach and NAC's ongoing effort on behalf of naturists there.

In June of this year, a California state court of appeal ruled in favor of the California Department of Parks and Recreation (DPR) in its appeal of a Superior Court’s ruling from 2008 that had favored naturists. The Naturist Action Committee and Friends of San Onofre Beach subsequently sought a ruling from the California Supreme Court. Today, the California Supreme Court declined to hear the case.

The appellate ruling was initially unpublished, but at the request of DPR, the appellate court later published the ruling. NAC requested that the ruling be de-published. However, as an adjunct to today’s announcement, the California Supreme Court refused NAC’s request to de-publish.

At issue in the lawsuit was whether DPR has followed proper procedure in abruptly ending the application of the Cahill/Harrison regulation at San Onofre State Beach. Cahill/Harrison is long-standing and well-known means for managing and regulating the clothing-optional use of portions of state parks.

TICKETS FOR NUDITY ARE POSSIBLE AT ALL CALIFORNIA STATE PARKS

The Supreme Court’s refusal to hear the case allows the possibility that rangers may immediately begin issuing citations for nudity under Title 14, Section 4322 of the California Code of Regulations. Because the appeal ruling was published, this threat applies not only at San Onofre State Beach, but at ALL UNITS OF THE CALIFORNIA STATE PARK SYSTEM.

I am not a lawyer, but I would guess that a refusal to hear a case is better than an adverse ruling. The short-term effect is the same, but there is an opening for another case sometime with a more favorable result.

Chuck,

This is such a frustration. Just as I was getting my feet wet (publicly) the beach gets closed.

I guess I will have to look for you at Blacks albeit without the surfboard. I agree to steep a walk for a nine foot surfboard.

Not to be negative...but I wonder how long before the fallout reaches Blacks and all the other state beaches.

Perhaps the next course of action is to seek the parks dept setting aside actual beaches for the purpose of nude use such as in the east. Florida gets along with us why can't such a progressive state as CA.

Anyway...hope to run into you again someday.
Blacks, Palm Springs, De Anza or perhaps Glenn Eden.

Somebody just published a list of reductions in services in state parks. Hopefully, one of the unintended benefits of the budget crisis is leniency toward nude sunbathers.
